Understanding the limits of client-money segregation

Client-money segregation is not insurance or a repayment guarantee. Review the legal entity, asset type, custodian, insolvency rules and coverage using valid documents.

A statement that client funds are held separately may describe an important safeguard, but its practical and legal meaning requires detail. Accounting separation, custody arrangements and rights during financial failure can be different issues. This article provides review questions, not broker approval or legal advice about a particular case.

Identify the company making the commitment

One brand may use several legal entities and agreements. Do not apply one entity’s or jurisdiction’s terms to every branded account. The contracting party, client classification and product must match the segregation document. A regulatory badge alone does not establish coverage of your account.

Which assets and custody arrangements are covered?

Cash, trading collateral and other assets may follow different rules. Ask what kind of institution holds the assets, in whose name they are recorded and which use or transfer restrictions apply. Missing information about part of the assets is not evidence of unrestricted protection. The word segregated needs a definition.

A hypothetical limited claim

Suppose a document concerns only cash belonging to clients of one company. It cannot automatically establish treatment of derivative claims, assets at another company or every client receivable. This example states no current country or provider rule. It shows why a claim must remain tied to the actual asset and contracting party.

Segregation differs from insurance and compensation

Where insurance or a compensation arrangement exists, separately inspect eligibility, limits, exclusions and covered events. Segregation does not itself create that coverage. Compensation for institutional failure also does not necessarily cover ordinary trading losses. Do not assume coverage for your account without valid evidence.

Contract-review questions

  • How are client funds or assets defined, and what is excluded?
  • Who is responsible for recording and reconciling balances?
  • Can assets be used, transferred or pledged under the agreement?
  • What process addresses a shortfall, dispute or financial failure?
  • Where are valid evidence and the latest terms available?

Separation does not establish immediate access

Even a valid arrangement may require time for administration, reconciliation and determining rights. Claim priority and recoverability depend on applicable law and contracts. This article estimates no repayment timetable or recovery amount. Protected wording must not become an assumption of certain, immediate liquidity.

Manager risk remains a separate question

Custody safeguards do not remove trading errors, costs, leverage or mandate breaches. Review the host agreement and management mandate separately. Good manager results do not resolve missing host information, while custody documentation does not guarantee strategy returns.

When reading trading-account information, keep protection claims with their documents, dates and scope. The help centre can explain terminology; personal legal implications require independent review. This article recommends no broker and guarantees no capital preservation.
